1. Introduction & Acceptance of Terms
Welcome to Yauma Property Management. By accessing this web platform, booking property consultations, submitting custom service forms, or formally executing any contract with our company, you confirm that you have read, recognized, and agreed to be legally bound by these Terms of Service. If you do not accept these parameters in full, you must immediately halt your use of our platforms and close related transaction channels.
2. About Yauma & Regulatory Status
Yauma Property Management is a Harare-based property services firm. We represent property evaluations, sales facilitation parameters, land clearing, structural development support, brick supplies, and related property administration consultancy services across the Republic of Zimbabwe.
3. Services Offered
Our service packages include, but are not limited to, the following functional areas:
- Property Evaluations: Compiling independent market assessments, land surveys, and condition checklists.
- Sales Support & Marketing: Implementing modern advertising campaigns, physical listing displays, and social media placement vectors.
- Due Diligence & Verification: Conducting title deed audits, land registry checks, and verification procedures before transaction sign-offs.
- Estate Facilitation: Support for the administrative preparation of deceased estate allocations under Zimbabwean laws.
- Physical Infrastructure: Residential foundation building, land clearing, earthmoving services, and structural brick supplies.
- Property Administration: Routine physical inspections, client relations, and coordination of repairs.
Clarifying Note: All services are subject to these Terms and any separate written mandate or service agreement. Where a service falls within a regulated category, we will inform the client of any limitations that apply until the relevant registration is complete. In such cases, we may work alongside registered third parties to ensure lawful delivery.
4. Engagement & Mandates
No binding service relationship, operational agency, or contract obligation exists on Yauma Property Management’s part until a formal written mandate or service agreement is signed by both representative parties. Verbal discussions or informal chats do not represent binding legal directives.
- Mandates specify precise operational objectives, durations, and fee metrics.
- For sales-related support running during our administrative transit period, mandates will be legally structured as corporate property consultancy agreements.
- Either party may alter scope only through subsequent bilateral written amendments.
5. Fees & Payments
All service pricing, milestones, and billing intervals are fully detailed in individual customer mandates or service agreements. Unless separately established in writing, the following norms apply:
- Evaluations and property due diligence fees are billed and fully invoiced upon final report compilation.
- Development, earthmoving, and build service fees are managed under scheduled project milestone invoices.
- All fees are calculated and quoted in United States Dollars (USD) or Zimbabwe Gold (ZiG) and remain exclusive of standard government taxes or registration duties unless stated otherwise.
6. Client Obligations
Every customer engaging Yauma Property Management warrants and commits to:
- Supply fully truthful, accurate, and up-to-date identification and ownership records.
- Promptly disclose any active courtroom arguments, unresolved boundary stakes, title encumbrances, or family disputes regarding listed fields or structures.
- Cooperate fully with our due diligence teams, enabling safe and lawful access to properties for physical inspections or technical reviews.
Submitting falsified paperwork, hiding key legal encumbrances, or acting in bad faith will lead to immediate contract termination and full client liability for any resulting business damages.
7. Limitation of Liability
To the maximum extent permitted under the laws of the Republic of Zimbabwe:
- Yauma Property Management shall not be liable for any indirect, special, incidental, punitive, or consequential losses (including but not limited to loss of potential profits, structural delays, or purchase cancellations).
- No liability is accepted for delays, errors, or access lapses originating from national registry archives, regulatory queues, or events of force majeure (such as weather events or technical utility failures).
- Our total cumulative liability for any claim, regardless of form, shall strictly not exceed the actual fees paid by the client for the specific service module giving rise to the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless Yauma Property Management, its officers, consultants, and technical operators from and against any lawsuits, losses, statutory fines, or financial expenses (including legal fees on an attorney-and-client scale) resulting from your breach of these Terms, the provision of misleading property documentation, or any violation of Zimbabwean property laws.
9. Intellectual Property
All brand components, custom vector assets, website source codes, photographic records, and literature formats displayed on this platform are the sole digital property of Yauma Property Management, protected under Zimbabwe intellectual property statutes. You are forbidden from scraping, copying, replicating, or using our materials for external commercial listings without express written consent.
10. Website Usage
You agree to use this web platform only for legitimate home inquiries, property viewing bookings, and administrative interactions. You must not attempt to upload malicious codes, scan our cloud environments for technical exploits, or enter high-risk database scripts into any form fields.
11. Termination
Either party may end a running property mandate or consulting contract by sending written notice as dictated in the active service contract. Yauma Property Management retains the unconditional right to immediately terminate any active client services if we discover that fraudulent files have been submitted, or if the client acts in persistent bad faith or breaches any element of these Terms.
12. Governing Law & Dispute Resolution
These Terms, as well as any contracts arising from them, are governed exclusively by the laws of the Republic of Zimbabwe. Every issue, conflict, or claim must first be addressed in good faith through standard bilateral negotiations.
If the parties fail to reach an agreed resolution within thirty (30) days from written notification of the conflict, the matter shall be submitted to professional mediation. If mediation fails to yield an outcome, the dispute shall proceed to the exclusive jurisdiction of the competent courts of Zimbabwe.
13. Amendments & Updates
Yauma Property Management reserves the right to revise or modify these Terms of Service at any time. Any changes will be published here with an updated Effective Date. Your continued engagement with our platforms or staff following such updates constitutes full acceptance of the revised Terms.
14. Service Disclaimers
- Evaluations: Evaluator assessments represent professional estimates of contemporary property potential and cannot be construed as a fixed guarantee of final market bids or future value metrics.
- Due Diligence: Diligence files compile records available through government registry offices at the time of review. We hold no liability for errors in public archives or hidden title flaws undetectable by reasonable standards.
